Terms of Service

These Terms of Service ("Terms") apply to your use of andnewme.com and of the services of Yeniben Elektronik Hizmetler ve Ticaret A.Ş., trading as &NewMe ("&NewMe", "we", "us"), Esentepe Mah. By using the website or our services you agree to these Terms. If you do not agree, please do not use them. Please also read our Privacy Policy. Nothing in these Terms reduces rights you have under mandatory law, including the consumer law of the country where you live.

&NewMe is a health tourism marketplace. We list independent hospitals, clinics, surgeons and agencies (together "Providers"), show information about them, help you compare them, and introduce you to the Providers you choose.

• We are not a medical provider. We do not diagnose, recommend or select a treatment, or make clinical decisions. All medical decisions, including whether you are suitable for a treatment, are made by the Provider's doctors.
• We are not a party to your treatment contract. When you book, your contract is with the Provider you book with (or the agency that sells you the package). That Provider is responsible for the services it sells you.
• Licensed intermediary. &NewMe holds an International Health Tourism Authorization Certificate (AK-0945). Where we coordinate parts of your trip ourselves (for example transfers, interpretation or scheduling), we tell you in writing, before you pay, what we do, what the Provider does and whose terms apply.

• Publish information about treatments, Providers and their doctors, including "from" prices, packages, reviews and ratings.
• Answer your questions and suggest Providers that may suit your treatment, budget and dates.
• Ask Providers for written quotes on your behalf and pass messages between you and the Providers you choose, including by WhatsApp.
• Help with practical coordination and language where the Provider and you want us to.
• Check, before we list a Provider, that the hospital or clinic holds the Turkish Ministry of Health licences it needs for international patients and that its doctors are licensed to practise in Türkiye. We review listings regularly, but we cannot check every statement a Provider makes.

Our information and introduction service is free for patients unless we tell you otherwise in writing before you use it.

The Provider you book with sets the terms of your booking. Quotes, prices, packages and what they include, deposits and payment schedules, cancellation and refund rules, any cooling-off period, complication insurance and aftercare are set by that Provider and stated in its written quote and contract. Please read them carefully before you pay anything, and ask the Provider or us if anything is unclear.

• Prices on the website are "from" or list prices for guidance, based on information from the Provider. The price in the Provider's written quote applies.
• A quote prepared from information you send remotely is an estimate. The Provider's doctors confirm your treatment plan, and the price may change if the plan changes after they examine you; the Provider must tell you and get your agreement before extra services are added, except in a medical emergency.
• Payments: treatment prices are set by the Provider. Depending on the booking (and, where offered, your choice), you pay in one of these ways: (a) directly to the Provider; (b) to the agency or facilitator listed as the Provider for your booking; or (c) to &NewMe through our secure payment page. Your written quote or booking confirmation always tells you who you are paying and for which Provider. When you pay &NewMe, we collect the payment on behalf of the Provider as its payment collection agent and pass it on; the contract for the treatment is still between you and the Provider, and the Provider's cancellation and refund terms in your quote apply.
• Cancellations, refunds and complaints about a booking are handled under the Provider's terms. We will pass your request to the Provider and help you follow it up.

• Patients do not pay us for comparing Providers, asking for quotes or our coordination, unless we tell you otherwise in writing before you use a service.
• Providers pay us. When a patient we introduced books with a Provider, that Provider pays &NewMe an intermediary fee (commission) under its agreement with us.
• Providers set their own prices. The price in your quote is set by the Provider. We do not add our fee on top of the quote, and you pay the Provider's quoted price.
• In the future, Providers may also pay us for enquiries (leads) or for featured placement on our website. Any paid placement will always be clearly labelled "Sponsored" or "Featured".

On treatment and surgeon pages, the default order is "&NewMe choice":

1. first, Providers we have selected editorially, based on our experience of working with them (for example responsiveness, clarity of quotes, patient feedback and how issues were handled);
2. then Providers with a named surgeon and a strong verified Google rating (4.5 or higher from at least 10 reviews);
3. then by the number of verified Google reviews.

You can re-sort the list by price, number of reviews or years of experience, and filter it (for example by hospital or surgeon gender).

• The commission a Provider pays us does not currently affect its ranking.
• If we introduce paid placement, those listings will be clearly labelled "Sponsored" or "Featured", and we will update this section.
• Google and Trustpilot ratings are shown as published on those platforms. Reviews collected by us come from patients who contacted us about that Provider.
• Provider profiles, prices, packages, photos and credentials come from the Providers and public sources. Providers are responsible for keeping them accurate and lawful, including Turkish rules on medical advertising.

Information on our website, in our messages and from our coordinators (including prices, "typical" results, recovery times, before-and-after photos and patient stories) is general information. It is not medical advice and does not replace a consultation with a qualified doctor.

• Every treatment carries risks, including complications, even when care is given properly, and results differ from person to person. Neither we nor any Provider can guarantee a medical outcome.
• A Provider may decline or change a treatment after assessing you, before or after you arrive.
• Please talk to your own doctor before travelling, especially if you have a medical condition, and follow your Provider's pre- and post-operative instructions.

Turkish regulation requires complication insurance for many surgical procedures performed on international patients. Most Providers include it in their packages; the insurer, the cover, its limits and any initial exclusion period depend on the Provider's plan and are stated in its quote. Please check them before you pay.

Complication insurance is not travel insurance. We recommend travel insurance that covers you abroad; tell your insurer about your planned treatment.

• Be 18 or over (or have a parent or guardian act for you).
• Give complete and accurate information about your health, medications and medical history to us and to Providers. Incomplete information can put your health at risk and may lead a Provider to postpone or cancel your treatment.
• Use the website lawfully. Do not copy, scrape or reuse our content or databases for commercial purposes, send false enquiries, upload malicious code, or interfere with the website or other users.
• Only share other people's personal data if you are allowed to.

• Reviews must be honest and based on your own experience. Do not post content that is unlawful, abusive, discriminatory, misleading, or that reveals other people's private or health information.
• We may moderate reviews to remove unlawful, abusive or personal content, but we do not edit reviews to change their meaning, and we do not offer payment or discounts for positive reviews. Providers cannot ask us to remove a genuine review only because it is negative.
• When you publish a review, photo or story on our website, you allow us to display it on andnewme.com and our social channels, with your name or initials as you choose. We only publish photos or medical details with your separate permission, and you can ask us to remove them at any time.
• Providers may reply publicly to reviews about them. We do not give a reviewer's identity or contact details to a Provider or anyone else; we disclose them to authorities only when a court or other competent authority formally requires it.
• We are responsible for the articles and treatment information we publish ourselves. For reviews and Provider profiles posted by others, we act as a hosting provider under Turkish Law No. 5651: we do not check all such content in advance, but we remove unlawful content when we are notified in line with the law. If you believe content infringes your rights, tell us at info@andnewme.com; we reply to personal-rights complaints within 24 hours.

The content on our website (text, design, logos, photos, databases) belongs to us or our licensors. You may use it for your personal, non-commercial research. You may not copy, republish or sell it without our written permission.

Each Provider is responsible for the services it sells you, including the medical treatment and the standard of care, and for its own quotes, contracts, refunds and insurance. &NewMe is responsible for its own services: the information we publish, the introductions and coordination we carry out, and the care we take with your data.

We take reasonable care that the information on our website is accurate and up to date, but we cannot guarantee that every Provider statement, price or availability is correct at all times. We are not responsible for a Provider's acts or omissions, except to the extent the law makes us responsible or we have caused the loss ourselves.

Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited, including liability for intent or gross negligence, for death or personal injury caused by our fault, and liability under the mandatory consumer protection law of the country where you live.

If you are unhappy with our own service, please tell us first at info@andnewme.com or +90 212 909 57 45. We aim to respond within 2 business days. Complaints about a Provider or the treatment should be raised with the Provider under its terms; tell us too, so we can help you communicate with it and take your feedback into account for its listing.

If you are a consumer living outside Türkiye, you can also contact the consumer protection body in your country. In Türkiye, consumers may also apply to the Consumer Arbitration Committees or Consumer Courts within the limits set under Law No. 6502.

We may change, suspend or stop parts of the website or our services, for example for maintenance or updates, and we may remove or limit listings or content that break these Terms or the law. We will try to keep interruptions short.

These Terms are governed by the laws of the Republic of Türkiye, and the Istanbul Courts and Execution Offices have jurisdiction. This does not take away any mandatory rights you have under the law of the country where you live, including the right to bring a claim in your own country where that law allows. Your contract with a Provider is governed by the law and jurisdiction stated in that contract.

We are not liable for delay or failure to perform where this results from circumstances beyond our reasonable control, such as natural disasters, war, epidemics, government action or transport disruption. What happens to your booking in these cases is set out in your Provider's terms.

We may update these Terms. The latest version is always on this page, with the "Last updated" date. Changes do not affect a booking you have already made with a Provider.
